Now, the New York City Council is stepping in, launching a formal investigation into several prominent companies offering these betting services. The probe targets major platforms—including Kalshi, Polymarket, Coinbase, and Gemini Titan—examining whether their marketing tactics have crossed the line into predatory territory by specifically targeting young adults and minors.

Council Speaker Julie Menin officially kicked off the inquiry by sending letters to the four companies. The council’s primary concern is that these platforms are utilizing “false and deceptive marketing,” largely driven by social media influencers, to lure in a younger demographic. Depending on the findings of this probe, New York City officials may introduce new legislation, public education campaigns, and stricter enforcement to curb these aggressive advertising strategies.

The Crackdown on Deceptive Influencer Marketing

The rapid rise of prediction apps has caught the attention of local lawmakers who worry about the financial safety of young New Yorkers. Council Member Shekar Krishnan, who chairs the committee on oversight and investigations, did not mince words when discussing the sheer scale of the problem.

According to Krishnan, apps like Polymarket are growing at an unchecked pace, and their unprecedented reach is largely due to predatory tactics. He noted that these platforms are actively preying on young adults and minors, utilizing deceptive and sometimes outright false marketing campaigns designed to pull vulnerable users in and drain their wallets. The focus of the city’s investigation is to uncover exactly how these influencer partnerships operate and whether they violate consumer protection standards.

A Growing Legal Showdown Over Regulation

This local investigation is just the latest chapter in what is shaping up to be a massive legal showdown between state and federal regulators. The core issue revolves around how to classify prediction market offerings, such as contracts tied to the outcomes of sporting events or elections. While many state-level gaming authorities view these activities as illegal sports betting, the Commodity Futures Trading Commission (CFTC) argues that these trades are technically “swaps,” placing them under federal oversight as commodities.

As the regulatory tug-of-war continues, the companies in the crosshairs are standing their ground. A spokesperson for Coinbase emphasized that the company offers its customers access to federally regulated prediction markets overseen by the CFTC, maintaining that they fully comply with all applicable laws. Polymarket also acknowledged the probe, stating they look forward to engaging with the New York City Council on the matter. Gemini has not yet issued a public response to the investigation.
