Trump Backs CFTC Authority Over Prediction Markets in Clash With State Regulators

President Donald Trump has firmly positioned himself in the ongoing regulatory battle over prediction markets, throwing his full support behind the Commodity Futures Trading Commission (CFTC). As state regulators increasingly crack down on these digital platforms, Trump insists that the CFTC must hold exclusive federal authority to ensure the industry continues to thrive in the United States.

Taking to his Truth Social platform, Trump emphasized that it is “critically important” for the federal agency to maintain total jurisdiction over the space. This bold statement arrives just as the legal tug-of-war between state and federal authorities reaches a boiling point, with major financial and crypto platforms caught directly in the crossfire.

Championing Federal Control Over State Regulators

The core of this legal conflict revolves around how prediction markets are classified. Multiple state authorities argue that platforms like Kalshi, Polymarket, Crypto.com, and Robinhood are effectively offering unlicensed gambling to residents. Consequently, these states have been actively issuing cease-and-desist orders and launching lawsuits to halt local operations.

Trump did not mince words when addressing these state-level actions. He specifically called out officials who have spearheaded these crackdowns—including Chris Christie, Letitia James, Tim Walz, and JB Pritzker—arguing that state-by-state regulation creates a disjointed, restrictive environment. According to Trump, his leadership aims to establish federal “rules of the road” that act as the gold standard, preventing individual states from stifling market innovation.

The CFTC, led by Chair Mike Selig, is fully aligned with this federal-first approach. The agency argues that prediction markets fall strictly under its jurisdiction as federally regulated designated contract markets. Pushing back against state interference, the CFTC has taken the aggressive step of suing states like New York, Illinois, Minnesota, and Arizona for attempting to police the platforms locally. Several prediction markets have also filed their own lawsuits to fend off state regulators, echoing the claim that only the CFTC has the authority to regulate their operations.

A Shifting Stance on a Booming Financial Industry

Trump’s aggressive defense of the industry marks a notable pivot in his public messaging. Just last month, the President expressed skepticism toward prediction markets after well-timed bets regarding the Iran war surfaced on these platforms. That incident drew sharp criticism from politicians pushing for stricter oversight, and at the time, Trump told reporters he was “not happy” and “never much in favor” of the platforms.

However, his tone shifted dramatically just days later. Highlighting the global race for financial innovation, Trump noted that other countries are actively embracing this new form of market, warning that the U.S. would “get left out in the cold” if it banned them. He now refers to prediction markets as a “major industry” that the country must aggressively protect to remain at the top of the global financial food chain.

This change in perspective also coincides with notable family ties to the sector. His son, Donald Trump Jr., is currently an investor and advisory board member for Polymarket, as well as an adviser to Kalshi. Meanwhile, the CFTC has been proactively preparing for the industry’s rapid growth, having established a dedicated advisory team earlier this year to oversee event contracts and ensure that all market participants meet strict anti-manipulation and integrity standards under the Commodity Exchange Act.
